Stewards Inquiry Dengcheng One (G027) & Fireman Freddy (K007)

The Macau Jockey Club Stewards today conducted an inquiry into an analysts finding of Cobalt above the threshold in a pre race blood sample taken from Dengcheng One (G027) which competed in Race 6, The GUIYANG, 60-40 (Class 3&4) 1050m on Friday 16th March 2018.

Evidence was taken from Dengcheng One’s Trainer Mr. J M Moore, Assistant Trainer Mr. J McCabe, the Scientific Manager of RASL Mr. P Zahra, Macau Jockey Club Senior Security Manager Mr. David Ng and Mr. J M Moore’s stable staff. 

After considering all of the evidence the Stewards issued the following charges to Trainer Mr James Moore;

  1. Mr Moore pleaded guilty to a charge under MJC Rule 51(2) in that he presented Dengcheng One (G027) to race with a prohibited substance in its system, namely Cobalt, at a level of 430mg /L in plasma, which is above the threshold of 25mg/L in plasma. After taking into account all of his mitigating factors, Stewards disqualified Mr Moore for a period of 20 months and in addition fined him the sum of HK$ 30,000. He was notified of his rights of appeal.
  2. Mr Moore pleaded guilty to a charge under MJC Rule 51(9) in that he failed in his responsibility to ensure that a pre race blood sample taken from Dengcheng One (G027) on Friday 16th March 2018 was free of a prohibited substance, namely Cobalt, which is a prohibited substance at a level of 430mg /L in plasma, which is above the threshold of 25mg/L in plasma. After taking into account all of his mitigating factors, Stewards disqualified Mr Moore for a period of 20 months. He was notified of his rights of appeal.
  3. The stewards ordered that both of these penalties be served concurrently.

After considering all of the evidence the Stewards issued the following charges to Assistant Trainer Mr James McCabe;

  1. Mr McCabe pleaded guilty to a charge under MJC Rule 14(xvii)(a) negligence in that whilst acting in his official capacity as Assistant Trainer in Mr James Moore’s absence, he accepted the responsibilities of Trainer and presented Dengcheng One (G027) to race with a prohibited substance in its system, namely Cobalt, at a level of 430mg /L in plasma, which is above the threshold of 25mg/L in plasma which is a breach of MJC Rule 51(2). After taking into account all of his mitigating factors, Stewards disqualified Mr McCabe for a period of 18 months. He was notified of his rights of appeal.
  2. Mr McCabe pleaded guilty to a charge under MJC Rule 14(xvii)(a) negligence in that whilst acting in his official capacity as Assistant Trainer in Mr James Moore’s absence, he accepted the responsibilities of Trainer and he failed in his responsibility to ensure that a pre race blood sample taken from Dengcheng One (G027) on Friday 16th March 2018 was free of a prohibited substance, namely Cobalt. Cobalt at a level of 430mg /L in plasma is a prohibited substance above the threshold of 25mg/L in plasma which is a breach of MJC Rule 51(9). After taking into account all of his mitigating factors, Stewards disqualified Mr McCabe for a period of 16 months. He was notified of his rights of appeal.
  3. Mr McCabe pleaded guilty to a charge under MJC Rule 14(xvii)(a) negligence in that whilst acting in his official capacity as Assistant Trainer in Mr James Moore’s absence, he accepted the responsibilities of Trainer and failed in his responsibility for the good management and training of horses in his charge which led to Cobalt being detected in a sample take from Dengcheng One (G027) at 430mg/L in plasma, which is a prohibited substance above the threshold of 25mg/L in plasma, which is a breach of MJC Rule 53(i)(a). He was disqualified for a period of 6 months. He was advised of his rights of appeal.
  4. The stewards ordered that all of these penalties be served concurrently.

Macau Jockey Club Stipendiary Stewards today concluded their inquiry from Friday 25th May 2018, into an analyst’s finding of Cobalt in excess of the threshold limit in the racehorse Fireman Freddy (K007) which competed in race 5, the CHANGCHUN 70-50 (Class 2&3) 1350m on Friday night 16 March 2018.

Further evidence was taken from Trainer Mr James Moore, Assistant Trainer Mr. James McCabe, the Scientific Manager of RASL Mr. P Zahra, Macau Jockey Club Senior Security Manager Mr. David Ng and Mr. J M Moore’s stable staff. 

After considering all of the evidence the Stewards issued the following charges to Trainer Mr James Moore;

  1. Mr Moore pleaded guilty to a charge under MJC Rule 51(2) in that he presented Fireman Freddy (K007) to race with a prohibited substance in its system, namely Cobalt, at a level of 21000mg /L in urine, which is above the threshold of 100mg/L in urine. After taking into account all of his mitigating factors, Stewards disqualified Mr Moore for a period of 20 months and in addition fined him the sum of HK$ 30,000. He was notified of his rights of appeal.
  2. Mr Moore pleaded guilty to a charge under MJC Rule 51(9) in that he failed in his responsibility to ensure that a post race urine sample taken from Fireman Freddy (K007) on Friday 16th March 2018 was free of a prohibited substance, namely Cobalt, which is a prohibited substance at a level of 21000mg /L in urine, which is above the threshold of 100mg/L in urine. After taking into account all of his mitigating factors, Stewards disqualified Mr Moore for a period of 20 months. He was notified of his rights of appeal.
  3. The stewards ordered that both of these penalties be served concurrently.

The Stewards further ordered that all disqualifications relating to both Dengcheng One (G027) and Fireman Freddy (K007) be served concurrently, however ordered that the monetary penalties be cumulative.

After considering all of the evidence the Stewards issued the following charges to Assistant Trainer Mr James McCabe;

  1. Mr McCabe pleaded guilty to a charge under MJC Rule 14(xvii)(a) negligence in that whilst acting in his official capacity as Assistant Trainer in Mr James Moore’s absence, he accepted the responsibilities of Trainer and presented Fireman Freddy (K007) to race with a prohibited substance in its system, namely Cobalt, at a level of 21000mg /L in urine, which is above the threshold of 100mg/L in urine which is a breach of MJC Rule 51(2). After taking into account all of his mitigating factors, Stewards disqualified Mr McCabe for a period of 18 months. He was notified of his rights of appeal.
  2. The Stewards further ordered that all disqualifications relating to both Dengcheng One (G027) and Fireman Freddy (K007) be served concurrently.
