RACING INCIDENT & INQUIRY:
Following the running of the race, the “Enquiry” Sign was semaphored and at the same time, the Stewards considered an objection lodged by Jockey L Corrales the rider of 5 Circuit Miles (4th placed getter) against 9 Snow Storm (K H Yu) being placed 3rd by the Judge for alleging interference in the home straight. Evidence was taken from Jockey L Corrales and Mr. N Moore the trainer or 5 Circuit Miles and Jockey K H Yu and Mr. J Lau the trainer of 9 Snow Storm. It was established that near the 100 metres 5 Circuit Miles had to be steadied and was shifted outwards to avoid the heels of 9 Snow Storm which shifted out under pressure. Then over the concluding stages 5 Circuit Miles was again taken wider on the track when brushed by 9 Snow Storm which continued to shift out under pressure. After considering all of the evidence and in particular the short head margin and the manner in which both horses were finishing of their races off, as the Stewards were satisfied that had the interference not taken place that 5 Circuit Miles would have finished ahead of 9 Snow Storm, the objection was upheld and correct weight was semaphored on the amended placings, as follows:
1st 2 Simon Fubuki (D Barros)
2nd 11 Yiucheung Champion (S Nakano)
3rd 5 Circuit Miles (L Corrales)
4th 9 Snow Storm (K H Yu)
At a subsequent inquiry, Jockey K H Yu the rider of 9 Snow Storm pleaded guilty to a charge of careless riding under MJC Rule 132 (i) in that near the 100 metres he failed to make sufficient effort to prevent his mount from shifting out when insufficiently clear of 5 Circuit Miles which had to be steadied and was shifted outwards to avoid the heels of 9 Snow Storm, resulting in 5 Circuit Miles losing its rightful running and was taken wider on the track. Jockey K H Yu was issued a monetary fine of HK$21,000 in lieu of a 3 racemeeting suspension. In arriving at penalty, the Stewards took into account Jockey K H Yu’s guilty plea, his poor disciplinary record in relation to careless riding and all mitigation factors. He was advised of his Right of Appeal.
